NEITHER HUNDRED DOLLARS ($100) NOR THE TOTAL AMOUNT OF FEES PRETTY-MOGUL HAS RECEIVED FROM YOU FOR THE USE OF PAID SERVICES DURING THE LAST SIX MONTHS, WHICHEVER IS GREATER, SHALL PRETTY-MOGUL’S AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICES EXCEED PRETTY-MOGUL’S ACTUAL LIABILITY.

 

YOU ACKNOWLEDGE AND AGREE THAT THE DISCLAIMERS AND THE LIMITATIONS OF LIABILITY SET FORTH IN THIS TERMS AND CONDITIONS REFLECT A REASONABLE AND FAIR ALLOCATION OF RISK BETWEEN YOU AND THE PRETTY-MOGUL PARTIES AND THAT SUCH LIMITATIONS FORM AN ESSENTIAL PART OF PRETTY-MOGUL’S ABILITY TO MAKE THE SERVICES AVAILABLE TO YOU ON
